Waite Park Man Won't Pay Fines Over Posting Anti-Islamic Fliers

Sidney Elyea of Waite Park will be getting a letter next week from the city telling him to stop hanging things on the city’s utility poles. He won’t be paying a fine, though.

An administrative hearing officer, in a ruling Friday, dismissed two $100 citations against Elyea, saying the city selectively prosecuted him after he hung anti-Islamic posters in December in violation of a city ordinance against posting materials.

Elyea’s Minneapolis lawyer is championing the decision as a win for the First Amendment. The St. Cloud city attorney said it is disappointing because the city believes it has a right to enforce its ordinance in a variety of ways.
